Dear Governor Murphy, Senate President Scutari and Assembly Speaker Coughlin:
We the undersigned members of the Thrive NJ coalition, alongside state and national partners, allies and advocates are urging you to take immediate action in light of the recent anti-abortion extremist attacks to time-sensitive medication abortion care.
The Texas case, Alliance for Hippocratic Medicine v. FDA, which seeks to rescind the U.S. Food and Drug Administrations’ (FDA) approval of mifepristone, a medication used safely for over 20 years for medication abortion and miscarriage care, was brought by extreme anti-abortion groups to a hand-selected, radical, Trump-appointed judge, leading to an egregious and unfounded decision that could reduce access to mifepristone across the country – including in states where abortion remains legal like New Jersey. While the full legal implications of these decisions still remain to be seen as the cases continue to move through the courts, what we do know is that any attempt to ban or further restrict access to abortion will fall hardest on the communities most harmed by systemic barriers to health care – that includes people of color, immigrants, people with low-incomes, youth, and people living in rural areas.
This case will likely be eventually heard by the U.S. Supreme Court, but let's be clear, it is not about science or patient safety. Rather, it is another attempt by anti-abortion extremists to further restrict and outright ban abortion care nationwide. While this attempt to erode the patient-provider relationship is egregious, this decision also sets a precedent that significantly disrupts ALL pharmaceutical research, threatening the autonomy of the FDA’s authority over ALL medication approvals, including vaccines. Given New Jersey’s standing as the nation’s “medicine cabinet” this is especially concerning.
Depending on how this case is ultimately resolved, already overwhelmed abortion clinics may need to dramatically shift their current protocols and patients will have to find additional resources to overcome barriers to care. This latest attack comes at a time when providers are already stretched to near-capacity given the influx of out-of-state patients coming to New Jersey for care. Every New Jerseyan deserves to live a safe life where they can make their own reproductive health care choices to access the care they need without fear, shame, or institutional obstacles.
To mitigate disruptions in abortion access, and remove barriers that continue to push abortion care out of reach for too many people, we urge leadership to take the following immediate actions:
● Allocate state funds to support abortion providers and expand coverage for reproductive health care services:
○ Continue to support existing abortion providers in the areas of staffing, training, abortion-related infrastructure, and security.
○ Include abortion care within the reproductive health care services covered through the FY24 Budget for communities who are ineligible for health insurance due to their immigration status.
● Take immediate legislative and regulatory action to remove ongoing barriers to reproductive health care and expand abortion access:
○ Pass the Reproductive Equity Act (S2918/A4350) to address financial and coverage barriers to abortion care
○ Direct the Department of Banking and Insurance (DOBI) to take regulatory action to mandate that all state regulated health insurance policies provide coverage for abortion care with no out-of-pocket costs for the patient.
● Deploy public education and community outreach efforts related to New Jersey’s reproductive rights and available health care services
○ Enact legislation to establish a state website with information related to New Jersey’s reproductive rights, health coverage options, and information on reproductive health care providers (S3275/A4829)
○ Increase public awareness for existing reproductive services by investing in widespread, multilingual public education and community outreach efforts related to reproductive rights, health and services.
With oral arguments on the Texas case set to begin before the Fifth Circuit Court on May 17, and with the one-year anniversary of the disastrous Dobbs v. Jackson Women’s Health Organization decision almost upon us, we urge our lawmakers to meet this moment with immediate action. It is clear grassroots and advocacy groups are willing to show up time and time again, and in the wake of this new threat, we will continue to increasingly strengthen the public call and make our voices heard until access for all is ensured through legislative, budgetary, and administrative change.
In this alarmingly critical moment, those of us on the frontlines of this fight call on Governor Murphy, and the New Jersey Legislature to once again act swiftly and meaningfully to expand abortion access for all in New Jersey.

Estimado Gobernador Murphy, Presidente del Senado Scutari y Vocero de la Asamblea Coughlin: los abajo firmantes, miembros de la coalición Thrive NJ, junto con aliados y defensores estatales y nacionales, les instamos a que tomen medidas inmediatas para responder a los recientes ataques extremistas contra el acceso al aborto en general y el aborto con medicamentos en particular.
El caso de Texas, Alliance for Hippocratic Medicine v. FDA, que busca revocar la aprobación de la Administración de Alimentos y Medicamentos de Estados Unidos (FDA por sus siglas en inglés) del medicamento llamado mifepristona, utilizado de manera segura durante más de 20 años para el aborto con medicamentos y la atención en caso de aborto espontáneo, fue presentado por grupos extremistas antiaborto ante un juez seleccionado por ser conservador y quien fue designado por la administración de Trump, lo cual llevó a una decisión infundada que podría reducir el acceso a la mifepristona en todo el país, incluido en los estados donde el aborto sigue siendo legal, como en Nueva Jersey. Si bien los impactos legales de esta decisión aún están por verse a medida que los casos continúan avanzando en los tribunales, lo que está claro es que cualquier intento de prohibir o restringir aún más el acceso al aborto afectará especialmente a las comunidades más perjudicadas por las barreras estructurales a la atención médica, lo cual incluye a las personas de color, los inmigrantes, las personas de bajos ingresos, los jóvenes y las personas que viven en áreas rurales.
Probablemente este caso será finalmente escuchado por la Corte Suprema de los Estados Unidos, pero debemos ser claros: este caso no se trata de ciencia o seguridad del paciente. Más bien, es otro intento de extremistas antiaborto de restringir aún más y prohibir el acceso al aborto a nivel nacional. Si bien este intento de socavar la relación entre paciente y proveedor es evidente, esta decisión también sienta un precedente que impacta significativamente TODA la investigación farmacéutica, amenazando la autonomía de la autoridad de la FDA sobre TODAS las aprobaciones de medicamentos, incluyendo las vacunas. Dado el estatus de Nueva Jersey como el "botiquín de medicamentos" de la nación, esto es especialmente preocupante.
Dependiendo de cómo se resuelva finalmente este caso, las clínicas que proveen servicios del aborto, que ya están sobrecargas, estarían obligadas a cambiar drásticamente sus protocolos actuales, y los pacientes deberán encontrar recursos adicionales para superar las barreras a la atención médica. Este último ataque se produce en un momento en que los proveedores ya están al límite de su capacidad debido al flujo de pacientes de otros estados que acuden a Nueva Jersey en busca de atención. Todos los habitantes de Nueva Jersey merecen vivir una vida segura en la que puedan tomar decisiones sobre su propia atención de salud reproductiva y acceder a la atención que necesitan sin temor, vergüenza u obstáculos institucionales.
Para mitigar las interrupciones en el acceso al aborto y eliminar las barreras que continúan obstaculizando la atención médica reproductiva para demasiadas personas, instamos a las autoridades:
● Asignen fondos estatales para apoyar a los proveedores de aborto y ampliar la cobertura de servicios de salud reproductiva:
○ Continuar apoyando a los proveedores de aborto existentes en las áreas de contratación de personal, capacitación, infraestructura relacionada a servicios del aborto y seguridad.
○ Incluir la atención del aborto dentro de los servicios de salud reproductiva cubiertos en el Presupuesto Estatal para el año fiscal 2024 para las comunidades que no califican para seguro de salud debido a su estatus migratorio.
● Tomar medidas legislativas y regulatorias inmediatas para eliminar barreras contínuas al cuidado de la salud reproductiva y expandir el acceso al aborto:
○ Aprobar la Ley de Equidad Reproductiva o The Reproductive Equity Act (S2918/A4350) para abordar las barreras financieras y de cobertura al cuidado del aborto.
○ Instruir al Departamento de Banca y Seguros (DOBI) a tomar medidas regulatorias para exigir que todas las pólizas de seguro de salud reguladas por el estado brinden cobertura para el aborto sin costos directos para el paciente.
● Implementar esfuerzos de educación pública y divulgación comunitaria relacionados con los derechos reproductivos de Nueva Jersey y los servicios de atención médica disponibles.
○ Promulgar legislación para la creación de un sitio web estatal con información relacionada con los derechos reproductivos de Nueva Jersey, opciones de cobertura de salud e información sobre proveedores de atención médica reproductiva (S3275/A4829).
○ Aumentar la conciencia pública sobre los servicios reproductivos existentes mediante la inversión en esfuerzos generalizados de educación pública y divulgación comunitaria en múltiples idiomas relacionados con los derechos, la salud y los servicios reproductivos.

Circuito el 17 de mayo, y en el aniversario de la desastrosa decisión Dobbs v. Jackson Women’s Health Organization casi sobre nosotros, instamos a nuestros legisladores a que respondan con acción inmediata. Es evidente que los grupos de base y de abogacía por la defensa de derechos están dispuestos a presentarse una y otra vez, y ante esta nueva amenaza, continuaremos fortaleciendo cada vez más la petición pública y haremos que nuestras voces se escuchen hasta que se garantice el acceso para todos a través de cambios legislativos, presupuestarios y administrativos.
En este momento crítico, aquellos de nosotros en primera línea de esta lucha instamos al Gobernador Murphy y a la Legislatura de Nueva Jersey a actuar una vez más de manera rápida y significativa para expandir el acceso al aborto para todos en Nueva Jersey.
